Overview
This Service Agreement is between MapCrush Websites, a service of MapCrush Local, and the business signing below ("Client"). MapCrush builds professional websites for local businesses of any type — contractors, salons, medical/professional practices, and more — along with optional ongoing hosting plans. This Agreement covers the website build and hosting only — it does not include GBP optimization or review management, which are covered under separate agreements if selected.
Build Type & Term
If Client is building under the qualified/accepted Scholarship program (as confirmed with MapCrush prior to signing), the build itself is one-time and complimentary with no obligation to purchase hosting. If Client has a Custom Build (as agreed directly with MapCrush), the Build Fee entered above applies as a one-time charge, invoiced separately by MapCrush. Either way, if Client selects a paid hosting plan afterward, it bills monthly and renews automatically.
The 7-Day Ownership Window — Important
Once your site is built, the preview link is only active for 7 calendar days from delivery. Client must claim the site (by selecting a hosting plan, or confirming they'll self-host/transfer it) within that window. If no action is taken within 7 days, the preview link and site are permanently deleted and cannot be recovered.
Site Ownership & Transfer
There is no catch: once claimed, the website files belong to Client, and Client is free to move or self-host the site elsewhere at zero cost and with no obligation to MapCrush. MapCrush provides no technical assistance with a self-managed transfer — if Client (or Client's own developer) breaks something during a self-managed move, that is on Client, not MapCrush. If Client instead wants MapCrush to personally perform the transfer to a new host or platform, MapCrush will invoice a separate one-time Transfer Fee to cover that work.
No Obligation
Client is never required to purchase any additional MapCrush service as a condition of receiving or hosting this website.
Late Payment (Hosting & Custom Build Fees)
If a scheduled hosting payment fails or is declined, MapCrush will attempt to charge the payment method on file for up to 5 business days, after which hosting may be paused until payment is resolved. For Custom Builds, MapCrush is not obligated to begin build work or deliver a completed site until the agreed deposit (or full fee, per the invoice terms communicated by MapCrush) has been received.
Limitation of Liability & Governing Law
MapCrush's total liability under this Agreement is limited to the amount Client paid MapCrush in the 30 days preceding any claim. MapCrush is not liable for indirect, incidental, or consequential damages, including lost profits or lost business from site downtime. This Agreement is governed by the laws of the State of California, and any disputes shall be resolved in the courts of Orange County, California.
